Intimate personal-wellness products are not returnable or exchangeable, subject to applicable law.
Products must be used privately, lawfully, consensually, and according to instructions.
These Terms include an adults-only requirement, a final-sale policy, responsible-use obligations, warranty disclaimers, liability limitations, and Florida governing-law provisions.
1. Acceptance of Terms
These Terms of Use form a binding agreement between you and the operator of ASSCENSION®, a Florida sole proprietorship. By accessing the website, creating an account, submitting information, or placing an order, you acknowledge that you have read, understood, and agreed to these Terms, the Privacy Policy, the Shipping Information page, the Disclaimer, and any product-specific instructions or policies presented at purchase.
If you do not agree, do not use the website or purchase products.
2. Adults Only; Legal Eligibility
You must be at least 18 years old and legally capable of entering a contract to use the store or purchase products. By ordering, you represent that the purchase, possession, importation, and intended use are lawful in your jurisdiction.
Products are intended only for private, lawful, informed, and consensual adult use. They may not be purchased for or supplied to minors.
3. Product Information and Responsible Use
Product photographs, colors, dimensions, packaging, accessories, features, and descriptions are provided for general identification and may vary because of display settings, manufacturing changes, photography, or supplier updates. The product page, package, and included instructions should be reviewed before use.
Do not rely on website content as medical advice. Follow all product instructions, inspect products before use, use only compatible chargers and accessories, and stop use if the product is damaged or causes pain, injury, irritation, numbness, bleeding, or unusual discomfort.
4. Orders, Acceptance, Pricing, and Availability
An order submission is an offer to purchase. We may accept, reject, limit, cancel, or require verification of an order for reasons including inventory, pricing or description errors, suspected fraud, payment issues, delivery restrictions, legal restrictions, misuse, or technical problems.
Prices, discounts, taxes, shipping charges, and availability may change without notice before purchase. We may correct errors and cancel affected orders. If payment was captured for a canceled order, the applicable amount will be refunded to the original payment method.
5. Payment and Fraud Prevention
You authorize our payment providers to charge the selected payment method for the order total and any clearly disclosed taxes or shipping charges. You represent that you are authorized to use the payment method and that the submitted information is accurate.
We may use fraud screening, identity or address verification, transaction review, and order limits. Fraudulent purchases, false claims, abusive chargebacks, or misuse may be reported to payment providers, carriers, platforms, insurers, or authorities as permitted by law.
6. Shipping, Final Sale, and Product Problems
The Shipping Information page is incorporated into these Terms. All sales are final and no returns or exchanges are accepted because the products are intimate personal-wellness goods with health and hygiene considerations, except where a remedy is required by law or approved for an incorrect, damaged, defective, or missing item.
Customers must follow the issue-reporting procedure and timing stated on the Shipping Information page. No product may be returned without written authorization.
7. Acceptable Website Use
You may not:
- use the website or products for unlawful, nonconsensual, deceptive, abusive, exploitative, or harmful conduct;
- attempt unauthorized access, interfere with security, scrape restricted content, introduce malware, overload systems, or circumvent technical controls;
- impersonate another person, submit false information, infringe rights, or misuse accounts, promotions, reviews, or payment systems;
- copy, reproduce, distribute, modify, reverse engineer, or commercially exploit protected website content except as expressly permitted by law; or
- use ASSCENSION® names, marks, imagery, product photographs, or content in a way that suggests sponsorship or authorization without written permission.
8. Intellectual Property
The website and its text, graphics, logos, photographs, videos, designs, layout, code, product names, slogans, and other content are owned by or licensed to ASSCENSION® and are protected by intellectual-property and unfair-competition laws.
ASSCENSION®, FREAKQUENCY™, related logos, and other source identifiers may not be used without authorization. No license is granted except a limited, revocable, nonexclusive right to access the website for personal, noncommercial shopping and information.
9. Messages, Reviews, and User Submissions
You retain rights you hold in content submitted to us. By voluntarily submitting a review, testimonial, photograph, suggestion, or other content for publication, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, display, and distribute that content for the purpose for which it was submitted, subject to applicable privacy law and any express written limitations.
You represent that submitted content is accurate, lawful, noninfringing, and does not reveal another person’s private information without permission. We may decline, edit, or remove submissions.
10. Third-Party Services and Links
The website may rely on or link to third-party platforms, payment providers, carriers, social media, analytics, or other services. Those parties control their services and may maintain separate terms and privacy practices. We are not responsible for third-party content, availability, security, decisions, or acts except to the extent responsibility cannot lawfully be excluded.
11. Disclaimer of Warranties
Some jurisdictions do not allow certain warranty exclusions. Nonwaivable consumer rights remain unaffected.
12. Limitation of Liability
To the fullest extent permitted by law, total aggregate liability arising from a particular order or event will not exceed the amount actually paid to ASSCENSION® for the product giving rise to the claim. This limitation does not apply to liability that cannot lawfully be limited, including liability resulting from fraud, willful misconduct, or other nonwaivable statutory rights.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ASSCENSION® and its operator, contractors, and service providers from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful or nonconsensual use, material breach of these Terms, infringement of another person’s rights, fraudulent conduct, or misuse of the website or products.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise.
Before filing a legal action, you agree to send a written description of the dispute to info@ASSCENSION.com and allow 30 days for a good-faith informal resolution. Unless applicable law requires another forum, exclusive venue for disputes will lie in the state or federal courts serving Broward County, Florida, and the parties consent to personal jurisdiction there.
15. General Terms
We are not responsible for delay or failure caused by events beyond reasonable control, including carrier disruptions, weather, labor disputes, shortages, outages, cyber incidents, government action, emergencies, or force majeure.
If a provision is unenforceable, it will be modified to the minimum extent necessary or severed while the remaining provisions continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without written permission; we may assign them in connection with a business transfer or reorganization. These Terms and incorporated policies constitute the complete agreement concerning the website and purchases, except for product-specific written terms.
16. Changes and Contact
We may update these Terms by posting a revised version and effective date. Changes apply prospectively unless law permits otherwise. Continued use after the effective date constitutes acceptance of the revised Terms.
